Important Bullet Points:

• While we accept most orders, we reserve the right to cancel and refund any order we find to be out of scope with your specific ticket details or even technologies running your website. You may always submit a custom request and we will be happy to answer any questions.
• The content of your website is solely expressed by you and/or your company. We have no affiliation to your opinions or messages expressed on your website.
• We do not work with websites that promote messages of hate, violence, racism, or vulgar language.
• You give us permission to sign in to your website admin account and make necessary changes as requested. We may also request FTP credentials to access your server.
• You give us permission to install and/or uninstall plugins or tools to help us with development and maintenance of your website.
• For holiday promotions or other time-sensitive updates, please provide at least 2 weeks notice prior to launching your promotion. Requests submitted sooner may result in a delay of update.

We are ourselves a small business and take pride in providing quality work for quality clients. We do our best at making sure all of your requests are addressed and in a timely fashion. If at any reason you are not satisfied with our work, please let us know and we will be happy to assist.

1. Disclaimer

A La Carte Web Services does not endorse or affiliate with the content, images, opinions, promotions, messages, articles, and languages expressed or displayed on our clients' websites.

2. One-Time Website Edit Fees

Customer agrees to pay for services purchased unless otherwise agreed to in writing. Please carefully review A La Carte Web Services's cancellation policy below. A La Carte Web Services may terminate this Agreement upon non-payment as set forth below.

3. Monthly Website Services

Fees for service(s) ordered by the Customer shall begin on the date of the initial order and that date shall serve as the monthly anniversary date (“Anniversary Billing Date”) for all future billings including one-time fees, upgrades, additional services, cancellations and service credits. Fees are due in advance of the monthly service cycle and will be billed on the anniversary date of each month. These fees, which prescribe our workload and future planning for workload are NON REFUNDABLE.

Additional service hours performed past the allocated amount will be billed at a rate of $100/hour and sent as a separate invoice.

Non-Payment: Failure to remit recurring payment for five (5) consecutive days past the Anniversary Billing Date may result in cancellation of our services. You will still have access to your own website.

4. Organic SEO

Since there are many external factors beyond our control when it comes to the complex search algorithms, there is no guarantee your pages will show up first result or first page, let alone selected by the searcher. What we do guarantee is the agreed-upon number of pages added to your website targeting the agreed-upon keywords. We make sure each new webpage is SEO-friendly, properly indexed with major search engines, and performs at it's full potential.

5. Upgrading

Upgrades made after your initial purchase will be billed at a pro-rated rate for the current month. Future charges will appear as full monthly fees added to your existing Anniversary Billing Date.

6. Cancellation

Cancellation of monthly services can be done at anytime within your dashboard under My Account, or simply email us at sales@alacartewebservices.com. Payment through the end of the Cancellation month must be made in full.

7. Refund Policy

Requests for a refund are accepted within a period of 30 days after the order is placed. Please make sure your request does not contradict our Terms and Conditions. Any refund request that is made after 30 days of the Order, then such a request would not be processed under any circumstance. Your order is valid for one full year since the the order was placed.

If you are unsatisfied with your order, please let us know and we will do what we can to accommodate in accordance to the scope of the ticket.

8. Identity Use

Unless otherwise requested by the Customer, we may include a link back to our site at the bottom of your website.

7. Laws

Customer agrees to abide by all local, state, and federal laws pursuant to services delivered in Denver, Colorado United States of America. Proper venue for legal remedies shall be located in Denver, Colorado. All contract terms found herein shall be governed by Colorado State Law or the Uniform Commercial Code, whichever may be applicable.

8. GDPR

In no event shall A La Carte Web Services be liable to Client for any compliance violations under the General Data Protection Regulation (GDPR) (EU) 2016/679. We do not take the role of your Chief Privacy Officer. We can work with you to address your GDPR-compliance needs on your website, but it is ultimately your responsibility to stay on top of handling of personal user data in accordance with the new regulation.

9. Limitation of Liability

In no event shall A La Carte Web Services be liable to Client for any indirect, special, exemplary or consequential damages, including any implied warranty of ability or fitness for a particular purpose or implied warranties arising from course of dealing or course of performance, lost profits, whether or not foreseeable or alleged to be based on breach of warranty, contract, negligence or strict liability, arising under this Agreement, loss of data, or any performance under this agreement, even if such party has been advised of the possibility of such damages and notwithstanding the failure of essential purpose of any limited remedy provided herein. There shall be no refunds. A La Carte Web Services makes no warranty of any kind, whether express or implied, with regard to any third party products, third party content or any software, equipment, or hardware obtained from third parties.
